The financial benefits of the gaming industry spread far beyond mere casino visits. According to the American Gaming Association, tax revenue received by state and local governments has been closing in on $10 billion annually in the past few years. Because of numbers like these, as well as a decline in the assumptions that casinos and other gambling facilities are breeding grounds for corruption and crime, the industry has been enjoying positive reactions of late. A recent report by the American Gaming Association says that casino gaming is viewed more favorably than ever before by voters across the political landscape.

This growth in popularity is not just confined to the U.S. As gambling locations around the world are experiencing their own increase in popularity. Gadling.com lists gaming locations in Macau, Singapore, Monaco, and Germany as among the most popular international gambling attractions.

Of course, no discussion of the recent explosion of gambling popularity would be complete without mention of the fastest growing segment of the industry: online gaming. As with many other businesses, the gambling industry has grown exponentially because of expanded Internet access. Forbes.com points out that the total worth of the worldwide online gambling market was $33 billion dollars in 2013 and all indications are that this number will only continue to rise.

All the excitement, competition and money incorporated in the brick and mortar casino experienced can now be found while sitting behind a computer. Gone are the days when computer gaming meant playing simple slots, roulette, or poker against an electronic opponent for credits that never translated into real money. It’s The Law, But Is It Safe?

If you’re reading this, you’re a fan of, or at least interested, online gambling. As such, you’re also aware that some online gaming sites and casinos are better, and certainly safer, than others. So a recently passed British law announcing that its Gambling Commission would now be policing many of the world’s regulated online casinos is a good thing, right?

Many online casinos are licensed to operate out of the tiny nation of Gibraltar, a British owned territory. Casinos here and in a few other locations are the only ones that British citizens may currently gamble in legally. This new law will allow gambling in a larger foreign market. Companies from as many as 165 jurisdictions around the world are taking advantage of this law to apply for British gaming licenses.

Well, competition’s not a bad thing, correct? However, Peter Howitt, head of the Gibraltar Betting and Gaming Association (GBGA), disagrees. He claims that the U.K. Gambling Authority has in fact, no authority to monitor and enforce regulations with these potential new casinos, because they fall outside of British sovereignty. New gambling law + new tax law = U.K. Gamblers moving to foreign unregulated sites, Howitt feels. The results of his equation? He feels that “significant” numbers of “unprotected” British players will begin using “unregulated or poorly regulated” gambling sites, and suffer financial and security theft as a result.

Is this sour grapes on the part of the GBGA, unhappy about losing potential customers? Is there anything they can actually do keep this from happening? Possibly. In addition to issuing a formal complaint, the GBGA may have found a legal loophole. Through their legal firm Olswang, the GBGA claims that the new U.K. Law is in violation of Article 56 of the Treaty on The Functioning of the European Union (TFEU). In a non-legalese nutshell? Olswang is claiming that this new law will have the British government sticking its nose into places where it doesn’t belong. Because of the filing of Olswang’s claim, the British government and its Gambling Commission can’t move forward with the new law until a judicial review is undertaken. They have 14 days to respond to the GBGA’s claim.

GBGA’a alternative to the new British law is a proposed program called “Passporting”. Under “Passporting”, British licensed casinos in various jurisdictions would be responsible for their own regulating, but would share information with the Gambling Commission.

Will the GBGA prevail? Is their concern for the online gambler sincere? Certainly as an industry, they have much to lose with potential increased competition and a loosening of industry standards. But as this case looks to drag on in courts for some time (and you probably don’t want to put your money on the GBGA), gamblers can protect themselves in the meantime. They are advised to thoroughly research any casino’s country of origin. They are advised to research said country’s gambling regulation (if any) practices. And as always, they are warned that when gambling in foreign waters (even from their sofa) they may be losing more than wagers.

The Incorrect Wire Act Arguments

The Interstate Wire Act is a law that’s been getting a lot of play of late by opponents of online gambling. According to these opponents this law makes online gambling illegal in the United States, and that’s that. These opinions are wrong though, and they’re either based off of a flawed understanding of the law, or a deliberate misinterpretation of what the law actually says.

What Does The Interstate Wire Act Say?

The Interstate Wire Act does outlaw a particular type of online betting; sports betting. However, the act doesn’t state that this kind of gambling is out-and-out illegal; sports betting is only illegal if it crosses state lines. So as long as someone is betting within his or her state, and that state doesn’t have any laws against that practice, then there’s no harm being done.

Furthermore, the Interstate Wire Act has no language in it regarding other forms of online gambling and betting. There’s nothing in it regarding online blackjack and poker, slot machines, roulette, or any other form of gambling. While there are some sources that claim the opposite, there have been no changes made to the infrastructure of states like Nevada where this kind of gambling is par for the course.

Why Online Gambling Won’t Be Further Restricted

While there will always be opponents to gambling (for whatever reason), it is very unlikely that the government will step in and impose harsh requirements on the industry as a whole. The reasons are fairly simple, too.

The first reason is that online gambling is providing a benefit without imposing a negative. The tax revenue alone is enough to make the online gambling industry a big part of states like Nevada and New Jersey. Restricting the industry means the losses of those revenues, but won’t mean the end of online gambling as individuals are more likely to seek out the activity elsewhere.

The second reason is that there’s very little imperative to attempt to dismantle an industry which is quite entrenched. Online gambling is not new, and it’s been around for a many years now. Decades, in some parts of the country. So the idea that the Department of Justice is going to suddenly declare as illegal businesses which have been running quite well for that long is ludicrous. It isn’t impossible, but it’s certainly impractical.

Online Gambling Continues to Grow

While there has been regulation regarding online gambling, and there is likely to be more as the years go on, very little of it is being done by the federal government. Incidents such as the recent licenses granted in New Jersey for online casinos and allowing foreign casinos to operate locally are a good example. States are taking initiative when it comes to online gambling, and generally speaking even though the federal government has the ability to regulate inter-state commerce it has so far chosen not to. The longer the federal government holds that position the harder it will be to get involved at some later date.

IT WAS WORTH IT TO DELAY THE OPENING

According to the owner, the choice to wait was a good one. If you open with a less-than-perfect product, it can damage the image of the company. This can be a bad thing in the long run. If the company image is damaged at the start of the race, sometimes it’s hard to recover from that, when compared to anything else.

So delaying the site was actually a better move to make on the part of Golden Nugget. When you consider all of the other competition, the delay was worth it, just ask the owner. The delay was not going to keep them from the top position they had been holding all of these years.

Golden Nugget is still one of the biggest faming sites. It already has plans to open up a virtual poker room this year/

NEW METHODS

One of the obstacles Golden Nugget still continues to face is with the banking methods. These banking methods include transaction with credit cards. There are other sites that have this issue too, it’s not just Golden Nugget. With the hold-up of the credit cards, many are concerned that the government will step in to spoil the fun.
